Section II Part A (2)
Directions:
Read the following four texts. Answer the questions after each text by choosing A, B, C or D. Mark your answers on the ANSWER SHEET. (40 points)
Text 2
P1Just how much does the Constitution protect your digital data? The Supreme Court will now consider whether police can search the contents of a mobile phone without a warrant if the phone is on or around a person during an arrest.

P2California has asked the justices to refrain from a sweeping ruling, particularly one that upsets the old assumption that authorities may search through the possessions of suspects at the time of their arrest. It is hard, the state argues, for judges to assess the implications of new and rapidly changing technologies.

P3The court would be recklessly modest if it followed California's advice. Enough of the implications are discernable, even obvious, so that the justices can and should provide updated guidelines to police, lawyers and defendants.

P4They should start by discarding California's lame argument that exploring the contents of a smartphone – a vast storehouse of digital information – is similar to, say, going through a suspect's purse. The court has ruled that police don't violate the Fourth Amendment when they go through the wallet or pocketbook of an arrestee without a warrant. But exploring one's smartphone is more like entering his or her home. A smartphone may contain an arrestee's reading history, financial history, medical history and comprehensive records of recent correspondence. The development of "cloud computing", meanwhile, has made that exploration so much the easier.

P5Americans should take steps to protect their digital privacy. But keeping sensitive information on these devices is increasingly a requirement of normal life. Citizens still have a right to expect private documents to remain private and protected by the Constitution's prohibition on unreasonable searches.

P6As so often is the case, stating that principle doesn't ease the challenge of line-drawing. In many cases, it would not be overly burdensome for authorities to obtain a warrant to search through phone contents. They could still invalidate Fourth Amendment protections when facing severe, urgent circumstances, and they could take reasonable measures to ensure that phone data are not erased or altered while waiting for a warrant. The court, though, may want to allow room for police to cite situations where they are entitled to more freedom.

P7But the justices should not swallow California's argument whole. New, disruptive technology sometimes demands novel applications of the Constitution's protections. Orin Kerr, a law professor, compares the explosion and accessibility of digital information in the 21st century with the establishment of automobile use as a virtual necessity of life in the 20th: The justices had to specify novel rules for the new personal domain of the passenger car then; they must sort out how the Fourth Amendment applies to digital information now.

26.
The Supreme Court will work out whether, during an arrest, it is legitimate to____
[ A ]prevent suspects from deleting their phone contents.
[ B ]search for suspects' mobile phones without a warrant.
[ C ]check suspects' phone contents without being authorized.
[ D ]prohibit suspects from using their mobile phones.

C(细节题)

The Supreme Court will work out whether

The Supreme Court will work out whether, during an arrest, it is legitimate to____ 主干是 The Supreme Court will work out whether...;whether 引导宾语从句,从句主语用形式主语 it,真正主语是后面的不定式(即四个选项接入处);during an arrest 是插入语,仅做时间限定,不影响主干。

P1

The Supreme Court will now consider whether police can search the contents of a mobile phone without a warrant if the phone is on or around a person during an arrest.

prevent suspects from deleting their phone contents 说的是「防止嫌疑人删手机内容」,这在 they could take reasonable measures to ensure that phone data are not erased or altered while waiting for a warrant 中是后文提到的「等令状期间警方的配套措施」,不是最高法院本案要裁决的问题。

search for suspects' mobile phones without a warrant 的 search for(寻找)+ mobile phones(手机本身)说的是「找出嫌疑人的手机」,而原文 search the contents of a mobile phone 是「搜手机里的内容」,宾语层级被偷换。

  • C)✓ 正确
    • search the contents of a mobile phonecheck suspects' phone contents
    • without a warrantwithout being authorized

prohibit suspects from using their mobile phones

27.
The author's attitude toward California's argument is one of____
[ A ]disapproval.
[ B ]indifference.
[ C ]tolerance.
[ D ]cautiousness.

  • A) 不赞成。
A(态度题)

The author's attitude toward California's argument is one of____ 中 attitude 一词直接亮明题型。

The author's attitude toward California's argument is one of____ 主系表结构:主语是 The author's attitude;toward California's argument 是后置介宾短语,限定态度的针对对象;is one of ____ 是「态度是……

  • A)✓ 正确
    • California's lame argumentdisapproval
    • should not swallow California's argument wholedisapproval

    预判极性为「强烈负面」,A 项 disapproval 是「不赞同」的标准态度名词,正好匹配 lame、recklessly modest、should not swallow whole 共同构成的负面情感共识。

(Enough of the implications are discernable, even obvious),是高度投入的批评者而非旁观者。

Enough of the implications are discernable, even obvious,毫不犹豫地下了判断,第 4 段更用 lame 这种直接的贬义词——并不谨慎,而是相当干脆地否定。

28.
The author believes that exploring one's phone contents is comparable to____
[ A ]going through one's wallet.
[ B ]handling one's historical records.
[ C ]scanning one's correspondences.
[ D ]getting into one's residence.

D(细节题)

The author believes that exploring one's phone contents is comparable to____ 主干 The author believes that ...;that 引导宾语从句,从句主语是动名词短语 exploring one's phone contents,谓语 is comparable to,宾语位置由选项的动名词短语填充——要求选项与主语在语法形态上对齐(都用 -ing 形式)。

P4

But exploring one's smartphone is more like entering his or her home.

    going through one's wallet 直接对应 going through a suspect's purse——但原文这是 California 提出、被作者用 But 否定的类比,不是作者本人认可的比拟对象。

    • entering his or her homegetting into one's residence

    预判要求选「住宅/家」类的比拟对象;D 项 getting into one's residence 与 entering his or her home 是几乎一一对应的近义替换,锁定 D。

29.
In Paragraphs 5 and 6, the author shows his concern that____
[ A ]principles are hard to be clearly expressed.
[ B ]the court is giving police less room for action.
[ C ]phones are used to store sensitive information.
[ D ]citizens' privacy is not effectively protected.

D(细节题)

In Paragraphs 5 and 6, the author shows his concern that____ 主句 the author shows his concern;that 引导同位语从句,补充说明 concern 的具体内容(即选项内容是「担忧」的具体所指);句首 In Paragraphs 5 and 6 是地点状语,限定证据范围。

P5

Citizens still have a right to expect private documents to remain private and protected by the Constitution's prohibition on unreasonable searches.

principles are hard to be clearly expressed 把原文 stating that principle doesn't ease the challenge of line-drawing 篡改为「原则难以清晰表达」;原文说的是「原则容易讲、边界难划」,难点不在「表达原则」而在「划定执行边界」。

the court is giving police less room for action The court, though, may want to allow room for police to cite situations where they are entitled to more freedom.

phones are used to store sensitive information 对应 keeping sensitive information on these devices is increasingly a requirement of normal life——但作者此处只是中性陈述「这是现代生活的必需」,并未把「存敏感信息于手机」本身当成担忧的对象。

  • D)✓ 正确
    • Citizens still have a right to expect private documents to remain private and protectedcitizens' privacy is not effectively protected
    • stating that principle doesn't ease the challenge of line-drawingcitizens' privacy is not effectively protected

    预判落点是「隐私名义有保障但实际未落地」,D 项 citizens' privacy is not effectively protected 恰好用「未被有效保护」一词概括了 still…right(应然)与 doesn't ease the challenge(实然难落地)之间的鸿沟,且情感极性为负面,与 concern 完全对齐。

30.
Orin Kerr's comparison is quoted to indicate that____
[ A ]the Constitution should be implemented flexibly.
[ B ]principles of the Constitution should never be altered.
[ C ]California's argument violates principles of the Constitution.
[ D ]new technology requires reinterpretation of the Constitution.

D(例证目的题)

Orin Kerr's comparison is quoted to indicate that____ 中 quoted to indicate 是例证目的题的标准提问。

Orin Kerr's comparison is quoted to indicate that____ 被动句:主语是 Orin Kerr's comparison;is quoted 是被动语态,省略的施事是作者;to indicate that...

P7

New, disruptive technology sometimes demands novel applications of the Constitution's protections. Orin Kerr, a law professor, compares the explosion and accessibility of digital information in the 21st century with the establishment of automobile use as a virtual necessity of life in the 20th: The justices had to specify novel rules for the new personal domain of the passenger car then; they must sort out how the Fourth Amendment applies to digital information now.

the Constitution should be implemented flexibly

principles of the Constitution should never be altered 说「宪法原则永远不应被改动」,但作者明确主张需要 novel applications of the Constitution's protections——「新的适用」本质上正是对原则的延伸/再解释,与「永远不变」相反。

California's argument violates principles of the Constitution 把第 7 段开头对 California 的反对(the justices should not swallow California's argument whole)拿来冒充 Kerr 引用的目的;但 Kerr 的引用本身只服务于「新技术需新适用」这一上位论点,并不直接评价 California 是否「违反宪法原则」。

  • D)✓ 正确
    • New, disruptive technology sometimes demands novel applications of the Constitution's protectionsnew technology requires reinterpretation of the Constitution
